1.馬云並沒有旡"恥",只是旡"齒",他是強,但是旡牙老虎.在假貨面前,有束手無策之感.在政府方面一法立,一弊生,道高一尺,魔高一丈.其實網上交易,有退貨方法才是仁至義盡.
2. 馬云提及管理是此一時彼一時.絕不能同日而語.在早期國外網商入侵,就是趁(商)機而入.馬云打退了云集外國商人.這是鴉片戰爭後,首次商戰勝利啊!
3.利用外資問題是整個世界商場上遊戲規則.世上是互通有旡,你中有我,我中有你,商場如戰場,開戰和和談同時舉行.商務部專家也是心知肚明一切過程,否則也不會寫出無恥二字.大家都是無所不極而不是無聰.這是商場之道了. |

既然是境外公司, 马云凭什么在中国找律师？跟海通有什么关系？
A 境外公司 can hire a law firm in China when its primary business activities occur in China under the 属地 doctrine。

When a reasonable reader compares what has been alledged with whatever has contained in the article, nothing can be found to be false.
The choice of word use such as "嘿嘿，无耻，就是这么炼成的" can not be taken by Mr. Ma Yun? His lawyer has really underestimate Mr. Ma Yun's emotional intelligence and to some degree disrespected him by treating Mr. Ma Yun-a public figure as a child. Whether to be 无耻 or not is a personal opinion. But by using this tactic to get a public attention, similarly to some dating news by a Chinese actor or actress, would have really made Mr. Ma Yun as an entertainment figure, perhaps he enjoys it as well for the personal branding purpose. :-)
Hi Mr. Ma Yun, you may have hired a wrong law firm as it does not know the requisite elements to constitute a prima facie defamation law suit for a suit to move ahead. On the other hand, it also shows the current status of Chinese legal system; if this article is the ground for Chinese court to take it as a case to move forward, I am sorry to say that Chinese legal system would have needed a significant reform, or 中纪委 needs to check into it how the case has been filed,... some lawyers will get sanctioned and lose their licenses, too. :-) |
